The rules are like this:

If there are only units from one player on a pad, that pad belongs to the player. You can see that the color of the pad will then be red, or blue.

If however units from both players are on the same pad, then this pad belongs to neither of the players. The color will be yellow then, as in your screenshot.

There is no "majority vote" where if you have more units on a pad than your opponent, it will be yours. I guess the reason for this is that on two-pad maps, you would very often have a stalemate then where both players solidly occupy one single pad each.
