ME2 LE the game retcon background to force Colonist

I've just finished a 34h perfect run of ME1 LE as a sentinel war hero spacer and when starting ME2 LE with my imported save, the game act like I'm a colonist when Jacob ask questions about Shepard background. All the save are flagged as spacer in game and I've checked it with a save editor, also used the unofficial patch to see if it does somenting but no.
