it just does not work

I have paid $60 for a new game and $50 for the premium services and the game does not go past the hit option button to start page on battlefield 3. why is this? can they be sued for false advertisement. I purchased something and it is not working

You can absolutely sue, if you have the resources and patience to pursue legal action.  Whether or not you'll be successful is another story.  

Or, request a refund.  The choice is and always will be yours.
